Welcome to Baba Bhairav Travels. These Terms & Conditions ("Terms") govern your use of our website (https://bababhairavtravels.com/) and all cab rental, outstation transit, tour packages, and associated booking services provided by us. By booking a service or using our platform, you agree to be legally bound by these Terms.

1. Definitions & Interpretation

In these Terms, "Company," "we," "us," or "our" refers to Baba Bhairav Travels, managed under the leadership of Santosh Dubey, with its primary office at AF-2/11, Raja Bazar Road, Nadesar, Varanasi - 221002, Uttar Pradesh, India. "Customer," "you," or "user" refers to any individual, corporate entity, or group booking services from us.

2. Booking & Confirmation

• Acceptance: All bookings made via WhatsApp, phone calls, or digital channels are subject to availability and vehicle dispatch confirmation by our command center.
• Advance Payment: To secure a vehicle or tour package, a nominal token advance payment may be required. Bookings are confirmed only upon receipt of this token amount or official confirmation notice from our team.
• Fare Calculation: Fares are calculated based on the agreed per-kilometer rate, package inclusions, or fixed route tariffs. Extra charges such as toll taxes, state entry permits, driver allowances, and parking fees apply as per actuals unless explicitly included in your custom package.

3. Cancellation & Refund Policy

• User Cancellation: If you wish to cancel a booking, you must inform our support team immediately. Cancellation fees may apply depending on how close the cancellation is to the scheduled pickup time.
• Company Cancellation: We reserve the right to cancel any booking due to unforeseen circumstances, extreme weather, civil unrest, vehicle breakdown, or safety hazards. In such cases, a full refund of any advance paid will be issued without liability for consequential damages.

4. Passenger Responsibilities & Conduct

• Punctuality: Passengers are expected to be ready at the designated pickup location on time. Waiting charges may apply if the vehicle is delayed due to passenger negligence beyond a reasonable grace period.
• Prohibited Items & Activities: Carrying illegal substances, firearms, explosives, or hazardous materials is strictly prohibited inside company vehicles. Smoking, consumption of alcohol, or illegal behavior will result in immediate termination of the trip without refund.
• Luggage & Valuables: Passengers are solely responsible for their personal belongings, luggage, and valuables. Baba Bhairav Travels is not liable for any loss, theft, or damage to personal property left behind in vehicles.

5. Fleet Operation, Routes & Force Majeure

• Route Discrepancies: Chauffeurs follow the most optimal, safe, and legal routes. If traffic blockades, road closures, or government restrictions (common around temple zones in Varanasi) require diversions, passengers agree to cooperate.
• Force Majeure: We shall not be held liable for failure to perform our obligations if such failure stems from acts of God, natural disasters, floods, strikes, highway roadblocks, government orders, or mechanical failures beyond reasonable control.

6. Limitation of Liability & Indemnification

To the maximum extent permitted by Indian law, Baba Bhairav Travels, its owner, and employees shall not be held liable for any indirect, incidental, special, or consequential damages arising from delays, missed flights/trains, or itinerary disruptions. You agree to indemnify and hold harmless Baba Bhairav Travels against any claims, losses, or legal costs resulting from your breach of these Terms.

7. Governing Law & Jurisdiction

These Terms & Conditions shall be governed by and construed in accordance with the laws of India. Any legal disputes, claims, or controversies arising out of or relating to these services shall be subject to the exclusive jurisdiction of the competent courts located in Varanasi, Uttar Pradesh.
